OVERVIEW

Welcome to PurrCurrent. The terms “we,” “us,” and “our” refer to PurrCurrent. PurrCurrent operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with an online shopping experience (the “Services”).

These Terms of Service, together with any policies referenced herein (“Terms”), describe your rights and responsibilities when you access or use our Services or purchase products from us.

Please read these Terms carefully before using our Services.

By visiting, interacting with, using our Services, or placing an order, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you should not use the Services.

Nothing in these Terms is intended to exclude or restrict any right or liability that cannot lawfully be excluded or restricted.

SECTION 1 — ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your state, province, country or jurisdiction of residence, or otherwise legally permitted to enter into the transaction.

You agree to provide accurate, current and complete information when using our Services or making a purchase, including your email address, billing information, payment information and shipping information.

You are responsible for maintaining the confidentiality and security of any account credentials associated with our Services and for activity occurring through your account.

You may not transfer, sell, assign or license your account to another person without our permission.

SECTION 2 — OUR PRODUCTS

We make reasonable efforts to provide accurate descriptions and representations of our products.

Colors, packaging, dimensions, appearance or other minor cosmetic characteristics may differ slightly from photographs shown on our website due to manufacturing variations, packaging updates, photography, screen settings or production batches.

Such differences do not permit us to materially misrepresent the product being sold.

PurrCurrent Cat Water Fountain

PurrCurrent products are intended to provide cats and other suitable household pets with access to drinking water in accordance with the supplied product instructions.

You are responsible for reading and following all product instructions, cleaning guidance, charging instructions, filter-replacement guidance and safety precautions.

Do not use the product in a manner that is inconsistent with the supplied instructions. Keep electrical or charging components away from improper water exposure where required by the product instructions, and use suitable charging equipment.

Filters and other consumable components require routine replacement and maintenance as described in the product instructions.

Pet Health and Results

Individual pets may respond differently to a water fountain.

PurrCurrent does not guarantee that every cat or pet will drink a particular amount of water, immediately accept the fountain, or prefer it over other water sources unless a specific guarantee is expressly stated in writing.

Statements concerning hydration, drinking habits or general pet wellness are intended as general product information and are not a substitute for veterinary advice, diagnosis or treatment.

PurrCurrent does not guarantee that use of the product will prevent, treat or cure kidney disease, urinary tract disease, dehydration or any other medical condition.

If you have concerns about your pet’s health, drinking habits, urination, appetite or behavior, contact an appropriate veterinarian.

SECTION 3 — ORDERS

By placing an order with PurrCurrent, you acknowledge that you have had the opportunity to review and agree that your purchase is subject to these Terms of Service, our Return & Refund Policy, Shipping Policy, Privacy Policy, Warranty Policy where applicable, and any other applicable policies made available on our website. Nothing in these policies limits any mandatory consumer rights that cannot lawfully be excluded.

PurrCurrent may accept or decline an order where reasonably necessary, including because of:

  • Product unavailability

  • Suspected fraud

  • Payment problems

  • Incorrect pricing or information

  • Shipping restrictions

  • Regulatory or legal restrictions

  • Incorrect customer information

An order is accepted when we confirm acceptance and successfully process the required payment.

If we cancel an order after collecting payment, the applicable amount will be refunded.

Please review your order carefully before submitting it. Once an order has entered fulfillment or shipping, we may be unable to cancel or modify it.

Purchases are subject to our Return & Refund Policy.

SECTION 4 — PRICES AND BILLING

Prices, discounts and promotions may change without notice.

The price charged for your purchase will generally be the price displayed when your order is submitted and confirmed.

We reserve the right to correct obvious pricing, typographical or technical errors.

If a material pricing error affects an order that has already been placed, we may contact you to offer the corrected purchase or cancel and refund the affected order.

Unless otherwise stated, product prices may not include shipping, taxes, customs, duties or other charges applicable to a particular destination.

You agree to provide current, complete and accurate billing and payment information.

You represent that you are authorized to use any payment method submitted for your purchase.

We may refuse, suspend or cancel an order where payment appears fraudulent or unauthorized.

SECTION 5 — SHIPPING AND DELIVERY

All delivery dates and delivery times displayed by PurrCurrent are estimates unless expressly stated to be guaranteed.

Shipping may be affected by carriers, customs processing, destination-country procedures, weather, public holidays, logistical disruptions or other circumstances outside our reasonable control.

PurrCurrent is not responsible for delays caused by shipping carriers, customs authorities or events outside our reasonable control, to the fullest extent permitted by applicable law.

Transfer of Risk

Risk of loss or damage remains with PurrCurrent until the order is delivered to the customer or an authorized recipient at the delivery address provided at checkout.

If an order is lost or materially damaged in transit, PurrCurrent will provide an appropriate replacement, refund, or other remedy in accordance with our Shipping Policy and applicable law.

You are responsible for providing a complete and accurate delivery address. To the fullest extent permitted by applicable law, PurrCurrent is not responsible for losses, failed delivery, delays, or additional expenses caused by incorrect or incomplete delivery information supplied by the customer.

However, this provision does not exclude or restrict any mandatory delivery, refund, or consumer right that applicable law does not permit the parties to waive.

SECTION 6 — INTELLECTUAL PROPERTY

The PurrCurrent name, logo, original branding, original website content, graphics, designs and other materials owned by PurrCurrent are protected by applicable intellectual-property laws.

Certain photographs, packaging, product materials, trademarks or other content may be owned by manufacturers, suppliers, Shopify, licensors or other third parties and remain the property of their respective owners.

Nothing in these Terms transfers any ownership rights to you.

You may not reproduce, distribute, commercially exploit, republish, modify or sell protected PurrCurrent content without our prior written consent except where applicable law allows otherwise.

Shopify's trademarks and intellectual property remain the property of Shopify or its licensors.

SECTION 7 — OPTIONAL TOOLS

We may provide access to tools offered by third-party providers that we neither control nor monitor.

Such tools may be provided “as is” and “as available.”

To the fullest extent permitted by law, we are not responsible for losses arising solely from your use of independent third-party tools.

You should review the terms and policies of the applicable third-party provider before using those services.

SECTION 8 — THIRD-PARTY LINKS

Our Services may contain links to third-party websites, applications or services.

We do not control those third parties and are not responsible for their content, products, services, security, policies or practices.

Accessing third-party websites is at your discretion.

Complaints relating solely to a third party's independent products or services should be directed to that third party.

SECTION 9 — RELATIONSHIP WITH SHOPIFY

PurrCurrent is powered by Shopify, which enables us to provide the Services.

However, purchases made through the PurrCurrent store are transactions directly between you and PurrCurrent.

Shopify is not the seller of PurrCurrent products.

To the fullest extent permitted by applicable law, Shopify and its affiliates are not responsible for claims, losses or damages arising from products purchased directly from PurrCurrent.

SECTION 10 — PRIVACY POLICY

Personal information collected through our Services is handled according to our Privacy Policy.

Because Shopify hosts our Services, Shopify may collect and process certain personal information relating to your use of our store.

Information may also be processed by payment providers, fulfillment providers, shipping companies and other service providers where reasonably necessary to operate our Services and complete your transaction.

SECTION 11 — FEEDBACK, REVIEWS AND USER CONTENT

If you voluntarily submit reviews, photographs, videos, suggestions, testimonials, comments or other content (“Feedback”), you represent that you have the necessary right to provide that content.

By submitting Feedback directly to PurrCurrent for publication or promotional purposes, you grant PurrCurrent a non-exclusive, worldwide, royalty-free license to reproduce, display, publish and use that Feedback in connection with our Services and marketing.

We will not knowingly alter genuine customer feedback in a way that materially misrepresents the customer's experience.

You may not submit:

  • Fake reviews

  • Reviews under a false identity

  • Content you do not have permission to use

  • Unlawful or defamatory material

  • Malicious software

  • Knowingly misleading information

We may remove content that violates these Terms or applicable law.

SECTION 12 — ERRORS, INACCURACIES AND OMISSIONS

Information on our Services may occasionally contain errors, inaccuracies or omissions concerning:

  • Prices

  • Promotions

  • Availability

  • Shipping costs

  • Delivery estimates

  • Other store information

We reserve the right to correct genuine errors and update inaccurate information.

If a material error affects an existing order, we will handle the matter fairly and in accordance with applicable law.

We may suspend or terminate your access to the Services where reasonably necessary, including because of fraud, abuse, security threats, unlawful activity or a material breach of these Terms.

You remain responsible for amounts lawfully due before termination.

Provisions that by their nature should survive termination will continue to apply.

SECTION 16 — DISCLAIMER OF WARRANTIES AND PRODUCT RESULTS

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, and except for warranties or promises expressly made by PurrCurrent, the Services and products are provided on an “as is” and “as available” basis.

PurrCurrent disclaims warranties, representations or conditions that may lawfully be disclaimed, whether express or implied, including warranties of merchantability, fitness for a particular purpose, durability and non-infringement.

Nothing in this section limits any express written warranty provided by PurrCurrent or any mandatory consumer rights that cannot lawfully be excluded.

We do not guarantee:

  • That every cat or pet will immediately use or prefer the fountain

  • That every pet will drink a specific amount of water

  • That use of the fountain will prevent, treat or cure kidney disease, urinary tract disease, dehydration or any other health condition

  • That filters will last for a specific period regardless of water quality, use and maintenance, unless expressly guaranteed

  • That rechargeable battery capacity will remain unchanged through ordinary aging and use

  • That the Services will always operate uninterrupted or error-free

Product Warranty

Where a PurrCurrent product is sold with a limited warranty, the applicable warranty duration and coverage are those stated on the product page, order materials or Warranty Policy applicable at the time of purchase.

Unless otherwise expressly stated, a limited warranty may cover manufacturing defects in materials or workmanship affecting normal operation, including covered defects affecting the pump, electronic controls, sensor, rechargeable battery, tank or tray.

Warranty coverage does not extend to exclusions clearly stated in the applicable Warranty Policy, which may include normal wear, cosmetic scratches, ordinary battery-capacity reduction, consumed filters, accidental damage, misuse, unsuitable charging equipment, failure to follow supplied instructions, unauthorized alterations or repairs, loss or theft.

Where a warranty claim is approved, PurrCurrent will provide the remedy stated in the applicable Warranty Policy and will honor all mandatory consumer rights that cannot lawfully be excluded.

Unknown Defects

To the fullest extent permitted by applicable law, PurrCurrent does not assume responsibility for a defect that was not known to PurrCurrent and could not reasonably have been known by PurrCurrent, except where applicable law imposes a responsibility that cannot be waived.

Nothing in these Terms permits PurrCurrent to knowingly conceal a material defect or make a false statement about a product.

If PurrCurrent becomes aware of a material product issue, we may investigate, correct product information, contact affected customers where appropriate, suspend sales, seek remedies from our supplier or manufacturer, or take other reasonable corrective action.

SECTION 17 — LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PurrCurrent, its owners, affiliates, employees, contractors, agents, suppliers and service providers will not be liable for indirect, incidental, special, exemplary, punitive or consequential damages, including lost profits, lost revenue, lost savings, lost data, business interruption or similar losses arising from your use of the Services or products.

Without limiting the above, PurrCurrent is not responsible, to the fullest extent permitted by law, for injury, loss or damage caused by:

  • Failure to follow product instructions

  • Improper assembly, setup, cleaning or maintenance

  • Use of unsuitable charging equipment

  • Unauthorized modification or repair

  • Using the product for purposes other than its intended use

  • Failure to replace or maintain filters as instructed

  • Contamination occurring after the product has been delivered

  • Damage caused by a pet, accident or other external event not attributable to a product defect

  • Continued use after damage, malfunction or another safety concern becomes apparent

  • Conduct of independent third parties outside PurrCurrent's reasonable control

The occurrence of a pet-health issue does not by itself establish that PurrCurrent caused or is legally responsible for that condition.

Customers should stop using a product if it appears damaged, unsafe or materially malfunctioning and contact PurrCurrent for assistance where appropriate.

Where a complaint suggests a possible product defect or safety problem, PurrCurrent may reasonably request information necessary to investigate the complaint, such as order information, photographs, videos, details concerning use and maintenance, and available batch or packaging information.

Maximum Lawful Protection

These limitations apply to the maximum extent permitted by applicable law.

Nothing in these Terms excludes or limits liability to the extent that applicable law does not permit it to be excluded or limited.

Nothing in these Terms protects PurrCurrent from responsibility for fraud, intentional deception or the deliberate concealment of a material defect known to PurrCurrent.

SECTION 18 — INDEMNIFICATION

To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless PurrCurrent, Shopify, and their respective affiliates, owners, officers, employees, contractors, agents, licensors and service providers from third-party claims, losses, liabilities and reasonable legal expenses arising from:

  1. Your material breach of these Terms;

  2. Your unlawful use of the Services;

  3. Your violation of another person's rights; or

  4. Your misuse of the product contrary to clear instructions or warnings.

This provision does not require you to indemnify PurrCurrent for liability that PurrCurrent cannot lawfully transfer to you.

SECTION 19 — SEVERABILITY

If any part of these Terms is determined to be unlawful, void or unenforceable, that provision will be limited or severed only to the extent necessary.

The remaining provisions will remain effective.

SECTION 20 — WAIVER AND ENTIRE AGREEMENT

Our failure to enforce a provision of these Terms immediately does not constitute a permanent waiver of that provision.

These Terms, together with our Privacy Policy, Return & Refund Policy, Shipping Policy, Warranty Policy where applicable, and other policies incorporated by reference, constitute the agreement governing your use of the Services.

No provision should be interpreted as overriding a mandatory legal right that cannot lawfully be waived.

SECTION 21 — ASSIGNMENT

You may not transfer or assign your rights or obligations under these Terms without our prior written consent except where applicable law permits otherwise.

We may transfer or assign our rights and obligations where reasonably necessary for legitimate business purposes, including a restructuring, acquisition, sale or transfer of the PurrCurrent business.

SECTION 22 — GOVERNING LAW

These Terms and any separate agreements through which PurrCurrent provides Services shall be governed and construed in accordance with the laws applicable in the jurisdiction in which PurrCurrent is legally established, without prejudice to mandatory consumer-protection rights that may apply to a customer and cannot lawfully be waived.

The parties agree to attempt in good faith to resolve disputes directly before pursuing formal proceedings where reasonably practicable.

Nothing in these Terms prevents either party from exercising a legal right to use an applicable court, regulator, consumer authority or dispute-resolution procedure.

The headings in these Terms are included for convenience only and do not limit or otherwise affect their interpretation.

You may review the current version of these Terms at any time on this page.

We may update these Terms from time to time to reflect changes in our Services, business practices or applicable requirements.

Material changes will take effect as required by applicable law.

Changes will not retroactively remove rights arising from a completed transaction where doing so is not legally permitted.
